Service Request Waiver, Release of Liability & Unclaimed Property Agreement

This Agreement is between Onewheel Services, operated by Cory A. Harding (“Onewheel Services,” “we,” “us”), and the person submitting a service, repair, or maintenance request through our website (“Customer,” “you”). By checking the box below and submitting your request, you agree to all terms in this Agreement. If you do not agree, do not check the box or submit a request.
1. Assumption of Risk
Onewheel and other self-balancing electric board devices carry inherent risks, including but not limited to falls, loss of control, and lithium-ion battery failure, overheating, or fire. You understand these risks and accept that no repair or service can eliminate them entirely.
2. Release, Waiver, and Indemnification
You release, waive, and forever discharge Onewheel Services, Cory A. Harding, and our employees, contractors, and agents from any and all claims, liability, damages, injuries, or losses — including but not limited to property damage, fire, personal injury, or death — arising from or related to:
- work performed by Onewheel Services on your board;
- the condition, age, or history of the board, including any prior repairs, modifications, or work performed by you or any other person or business before it was brought to us;
- any defect, malfunction, or failure of parts (including batteries, motors, controllers, or firmware) that existed before or arises after our service, whether or not caused by our work; and
- your use of the board after it is returned to you.
You further agree to indemnify and hold harmless Onewheel Services and Cory A. Harding from any third-party claim, cost, or expense (including legal fees) arising out of your board, its repair history, or your use of it, except to the extent caused by our gross negligence or willful misconduct.
3. Diagnostic and Repair Limitations
Onewheel boards are complex electronic devices, and some issues (particularly internal battery or board-level electrical faults) cannot always be fully diagnosed or guaranteed fixed. We will let you know what we find, but we do not warrant that every issue can be identified or permanently resolved, and we are not responsible for unrelated or pre-existing faults that surface during or after service.
4. Unclaimed Boards — 60-Day Policy
Once your board is ready for pickup or we are otherwise unable to complete service and need to return it to you, we will attempt to contact you using the phone number, email, or other contact details you provided with your request.
If you do not respond, arrange pickup, or otherwise make contact with us within 60 days of our first attempt to reach you, you agree that:
- the board will be treated as abandoned and unclaimed;
- you relinquish all right, title, claim, and interest in the board; and
- Onewheel Services may retain, sell, dispose of, or otherwise deal with the board to recover unpaid repair or storage costs, subject to any notice steps required under Alberta’s Repairs and Storage Liens Act.
This 60-day period runs from our first attempt to contact you, not from the date you dropped off the board, and applies whether or not repair costs are owed.
5. Governing Law
This Agreement is governed by the laws of the Province of Alberta and applicable federal laws of Canada.
6. Acknowledgement
I have read and understood this Agreement, and I agree to its terms, including the release of liability, indemnification, and the 60-day unclaimed property policy described above.
